WHEREAS, Rentaba provides a service to collect and verify certain consumer data, primarily related to rental payment history and other tenancy-related information;
WHEREAS, the Consumer desires to permit Rentaba to furnish this permissioned data to credit reporting agencies, including Experian, Equifax, and TransUnion, for the purpose of potentially impacting the Consumer's credit report and score;
NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein, the parties agree as follows:
1. Purpose of Agreement
This Agreement grants Rentaba your express authorization and consent to transmit specific permissioned data, as defined below, to credit reporting agencies (collectively, "CRAs"), including but not limited to TransUnion, Experian, and Equifax, for the purpose of credit reporting, credit scoring, and other related services offered by CRAs. This data may be used by CRAs to create or update your consumer report.
2. Permissioned Data Defined
The "Permissioned Data" covered by this Agreement includes, but is not limited to:
a. Personal Identifying Information (PII): Your full legal name, current and previous addresses, date of birth, Social Security Number (SSN), and other identifiers necessary for accurate reporting.
b. Rental Account Information: Landlord's name and contact information, property address(es), lease start and end dates.
c. Payment History: Detailed records of your rent payments, including payment amounts, payment dates, and any instances of late payments, missed payments, or lease violations as reported by your landlord or property manager to Rentaba.
d. Account Status: Current status of your rental account (e.g., active, closed, satisfied).
e. Other Tenancy-Related Information: Any other data points directly related to your tenancy that Rentaba collects with your explicit consent or that are necessary for accurate and complete credit reporting, consistent with applicable law.
4. Use of Data by CRAs
You understand and agree that CRAs may use the Permissioned Data furnished by Rentaba for purposes including, but not limited to:
a. Compiling and updating consumer credit reports.
b. Generating credit scores and other risk assessment tools.
c. Verifying your identity.
d. Assisting third parties (e.g., landlords, lenders, employers, insurers) in making credit, rental, employment, or other business decisions about you, in compliance with applicable law.
e. Internal data analysis, modeling, and product development by CRAs, in an anonymized or aggregated format where permissible.
5. Data Accuracy and Dispute Resolution
a. Consumer's Responsibility: You are responsible for ensuring the accuracy of the information you provide to Rentaba. Please review all information carefully.
b. Disputes with Rentaba: If you believe any Permissioned Data reported by Rentaba is inaccurate or incomplete, you must notify Rentaba in writing at dispute@rentaba.co. Rentaba will investigate your dispute promptly and correct any inaccurate information within its control.
c. Disputes with CRAs: For disputes regarding information appearing on your credit report that originated from Rentaba, you should follow the dispute procedures established by the respective CRA. Rentaba will cooperate with CRA investigations as required by law.
6. Revocation of Consent
You may revoke your consent to Rentaba furnishing your Permissioned Data at any time by providing written notice to Rentaba at support@rentaba.co. Upon receipt of your revocation request, Rentaba will cease furnishing your data to CRAs within a commercially reasonable timeframe, subject to any existing reporting obligations or legal requirements. Please note that revocation of consent will not remove data already reported to CRAs, but it will prevent future reporting.
7. Limitation of Liability
Rentaba shall not be liable for any damages, losses, or costs arising from:
a. The accuracy or completeness of data provided by the Consumer.
b. The actions or omissions of any CRA, including their use, storage, or dissemination of the Permissioned Data.
c. Any impact on the Consumer's credit report or score resulting from the reporting of Permissioned Data.
d. Any unauthorized access to or disclosure of Permissioned Data, unless such access or disclosure is due to Rentaba's gross negligence or willful misconduct.
8. Indemnification
You agree to indemnify, defend, and hold harmless Rentaba, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to your breach of this Agreement or your provision of inaccurate or incomplete information to Rentaba.
9. Arbitration Clause
Any dispute, controversy, or claim arising out of or relating to this Agreement, including the breach, termination, or validity thereof, shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator appointed in accordance with those Rules and seated in Philadelphia, Pennsylvania; you may take part by phone or video, or in your home county where the Rules allow. The award of the arbitrator shall be final and binding upon the parties, and judgment on the award may be entered in any court having jurisdiction thereof. The parties agree that this arbitration provision shall be governed by the Federal Arbitration Act, and that disputes are otherwise handled as described in Section 17 of Rentaba’s Terms of Service.
10. Privacy Policy
This Agreement is subject to and supplemented by Rentaba's Privacy Policy, which is available at https://www.rentaba.co/privacy-policy. By accepting this Agreement, you acknowledge that you have read and understood Rentaba's Privacy Policy.
11. Terms of Service
This Agreement is subject to and supplemented by Rentaba's Terms and Conditions, which is available at https://www.rentaba.co/terms-of-service. By accepting this Agreement, you acknowledge that you have read and understood Rentaba's Terms and Conditions.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.
13. Entire Agreement
This Agreement, together with Rentaba's Privacy Policy and Terms and Conditions, constitutes the entire agreement between you and Rentaba concerning the subject matter hereof and supersedes all prior and contemporaneous agreements, proposals, or representations, whether written or oral.
14. How You Accept This Agreement
You accept this Agreement by an affirmative act in the Rentaba app: checking the consent box or clicking “I agree” when you sign up for rent reporting, or when you later authorize Rentaba to furnish your rental data. That act is your electronic signature and is legally binding and enforceable to the same extent as a handwritten signature.
Reading this page does not, by itself, create an agreement. This page is the reference copy; the version you accept in the app at the time of your consent is the version that governs your authorization.
You may request a copy of the Agreement you accepted, or withdraw your consent under Section 6, at any time by emailing support@rentaba.co.
