Rentaba Terms of Service

These Terms of Service ("Terms") apply to all websites (the "Site" or "Sites"), including those hosted on the domains "www.rentaba.co," and any associated mobile applications provided by Rentaba and/or its affiliates ("Rentaba," "we," "us," or "our"). These platforms offer information and selected functionality to interested parties ("User," "Users," "you," or "your") through Rentaba’s services ("Rentaba Services") or services offered by landlords, property managers, property owners, or other third-party providers ("Providers") ("Provider Services").

‍PLEASE READ THESE TERMS OF SERVICE AND OUR PRIVACY POLICY (COLLECTIVELY, THE "AGREEMENT") CAREFULLY, AS THIS AGREEMENT FORMS A LEGALLY BINDING CONTRACT BETWEEN YOU AND RENTABA. IF YOU DO NOT AGREE TO THIS AGREEMENT, PLEASE DO NOT ACCESS OR USE THE SITE. BY ACCESSING, DOWNLOADING, OR USING THE SITE, YOU AGREE (1) TO BE BOUND BY THIS AGREEMENT, (2) YOU ARE AT LEAST 18 YEARS OLD, (3) YOU HAVE READ AND UNDERSTAND THIS AGREEMENT, AND (4) YOU ACCEPT THIS AGREEMENT.

‍Portions of this Site serve as a platform for Providers to offer Provider Services. Rentaba does not own or manage properties listed on the Site and does not enter into rental agreements for those properties. While the Site may facilitate transactions between Rentaba and Users, Rentaba is not a party to transactions between Users and Providers, except for providing the Site.

‍AS A RESULT, RENTABA SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCES FOR INFORMATION, DOCUMENT CONTENTS, OR ANY INTERACTIONS BETWEEN USERS AND PROVIDERS THROUGH THE SITE.

‍You are responsible for your use of the Site, and Rentaba encourages all Users to exercise sound judgment when engaging in transactions. IF YOU HAVE A DISPUTE WITH A PROVIDER, YOU RELEASE RENTABA FROM ALL CLAIMS, DEMANDS, AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF ANY KIND, KNOWN OR UNKNOWN, ARISING FROM SUCH DISPUTES.

1) Modifications to This Agreement

‍a) We may update, modify, add, or remove portions of this Agreement ("Update") at any time at our sole discretion without prior notice. Updates take effect immediately. If we make changes, we will update the "Last Updated" date above. Your continued use of the Site confirms acceptance of the Update. Review this Agreement regularly to stay informed. If you do not agree with an Update, you must stop using the Site.

‍2) Ownership; Proprietary Rights

‍a) You acknowledge that the Site, Rentaba Services, and Provider Services may contain proprietary content, information, and technology owned or licensed by Rentaba, protected by intellectual property laws ("Rentaba Content"). This includes, but is not limited to, data, text, software, images, videos, and other materials copyrighted under U.S. and international laws. All rights reserved.

You agree not to reproduce, copy, distribute, sell, or create derivative works from Rentaba Content without prior written permission. All trademarks, logos, and service marks ("Rentaba Marks") are owned by Rentaba unless stated otherwise. Unauthorized use of Rentaba Marks is prohibited.

‍3) Guidelines; Prohibited Conduct

‍a) You agree not to engage in the following prohibited activities:i

) Use the Site to harass, stalk, defame, or threaten others.

ii) Use the Site if under 18 years old.

iii) Use the Site for illegal purposes or in violation of laws.

iv) Send unsolicited advertisements or spam.

v) Impersonate others or access accounts without authorization.

vi) Misrepresent the source or identity of information.

vii) Disable security features or interfere with Site functionality.

viii) Upload malicious code or overload our infrastructure.

ix) Post offensive, defamatory, or illegal content.

x) Infringe intellectual property rights.

xi) Attempt unauthorized access to the Site.

xii) Hack, spam, or phish Rentaba or other Users.

xiii) Hold Rentaba responsible for your Site usage.

Report violations to support@rentaba.co. Rentaba reserves the right to deny access without notice.

‍4) Usage; Content; Service Suspension

‍a) Rentaba may monitor User activity and disable access at its discretion.

b) You are solely responsible for interactions with other Users.

c) Rentaba does not pre-screen third-party content ("Non-Rentaba Content") and disclaims liability for its accuracy or legality.

d) Rentaba may remove Non-Rentaba Content violating these Terms.

e) Rentaba provides only its Services as described; it is not responsible for:

i) Provider services.

ii) Payment processing, insurance, or other third-party offerings.

iii) Lease agreements or negotiations.

iv) Legal or professional advice.

v) Property inspections or screenings.

vi) Verification of listings or advertisers.

f) You consent to Rentaba contacting you via email, SMS, mail, or phone.

g) Rentaba may retain positive tenant records indefinitely; negative records follow legal requirements.

h) Rentaba cannot guarantee how shared information affects credit reports or scores.

‍5) Additional Requirements

‍a) Certain Rentaba Services may have additional terms posted on the Site ("Rentaba Requirements"). These take precedence over conflicting Terms.

b) Providers may impose their own requirements; Rentaba is not responsible for these.

‍6) Account Registration and Use

‍a) To access certain features, you must register an account with personal information.

b) You agree to provide accurate information and keep it updated. Rentaba may suspend accounts with false details.c) Protect your password and notify Rentaba immediately of unauthorized access.

d) The Privacy Policy governs data use; conflicts are resolved in favor of the Privacy Policy.

e) You warrant that submitted information is lawful and accurate.

‍7) Interactive Areasa) Public forums ("Interactive Areas") allow User comments ("Comments"). Rentaba may use Comments for marketing but reserves the right to remove inappropriate content.b) Rentaba is not liable for User interactions in Interactive Areas.

‍8) Third-Party Sites and Links

‍a) The Site may link to third-party websites. Rentaba does not endorse or control these sites and disclaims liability for their content.

‍9) User Restrictions

‍a) You may not:

i) Reverse-engineer or modify the Site.

ii) Use the Site for unauthorized commercial purposes.

iii) Remove copyright notices.

‍10) Violations; Termination

‍a) Rentaba may terminate accounts for violations without notice.

‍11) Disclaimers; No Warranties

‍a) The Site is provided "AS IS" without warranties. Rentaba disclaims all implied warranties.

b) Rentaba does not guarantee uninterrupted or error-free service.

‍12) Indemnification

‍a) You agree to indemnify Rentaba against claims arising from:

• Your misuse of the Platform;
  
• Violations of this Agreement;
  
• Infringement of third-party rights.
  

13) Limitation of Liability

RENTABA’S TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO $100 USD. We are not liable for:

• Indirect, incidental, or punitive damages;
  
• Provider actions or omissions;
  
• Platform downtime or data loss.
  

14) Benefit of the Bargain

‍a) These limitations reflect a fair risk allocation between you and Rentaba.

‍15) Release

‍a) You release Rentaba from claims related to Provider interactions or third-party sites.

‍16) Disputes; Arbitration

‍a) Disputes are governed by Pennsylvania law. Arbitration is mandatory for User-initiated disputes, waiving jury trials and class actions.

‍17) Miscellaneous

‍a) Severability: If any provision is unenforceable, the rest remain valid.

b) Notices: Rentaba may notify you via email or Site postings.

c) Assignment: Rentaba may transfer this Agreement; you may not.

d) Survival: Liability and indemnity clauses persist after termination.

By accessing or using the website www.rentaba.co ("Site" or "Platform") or any services provided by Rentaba. and/or its affiliates ("Rentaba," "we," "us," or "our"), including but not limited to services offered on www.rentaba.co (collectively, the "Services"), you agree to be bound by these Terms of Use ("Terms"). These Terms apply both to you as an individual and to any organization that has authorized your access via a separate agreement with Rentaba.

‍IF YOU DO NOT AGREE TO THESE TERMS, IMMEDIATELY DISCONTINUE USE OF THE SITE AND SERVICES.

Your acceptance of these Terms becomes effective upon first use of the Platform. Rentaba reserves the right to modify these Terms at any time without prior notice. Continued use after changes constitutes acceptance. The current version is always available via the "Terms of Use" link on our Site. For questions, contact support@rentaba.co.Paid Services (including free trials) are subject to additional terms outlined in the "Paid Services" section below. Violations may result in account suspension/termination without refund.

‍1. Account Requirements

‍1.1 Eligibility: You must:

• Be 18+ years old;
  
• Provide accurate Registration Data (full legal name, valid email/phone, date of birth, etc.), which may be collected via third-party services;
  
• Be a human (no shared logins among multiple users).
  

1.2 Responsibility:

• You and any authorizing organization are jointly liable for all account activity.
  
• Never share passwords or access another user’s account.
  
• Notify Rentaba immediately of unauthorized use.
  
• Rentaba may terminate accounts for violations or inaccurate information without refund.
  

2. Description of Services

‍2.1 General:

• Services may be offered in free or paid versions.
  
• Rentaba reserves the right to modify or discontinue features without notice.
  

2.2

‍Paid Services:

• Subscription Fees: Automatically renew monthly/annually unless canceled 30+ days before renewal. Fees are non-refundable, including for partial periods or unused time.
  
• Taxes: You are responsible for all applicable taxes.
  
• Price Changes: Rentaba may adjust prices without notice.
  
• Cancellation: Contact support@rentaba.co to cancel.
  

3. Usage Restrictions

‍You must:

• Be a landlord, property manager, renter or equivalent using Services for legitimate rental purposes.
  
• Not use Services for employment screening.
  

Only disclose personal information:

• a) To ensure debt payment;
• b) To prevent fraud;
• c) With individual consent;
• d) For tenancy purposes;
• e) For lawful investigations;
• f) For internal management.
  

You acknowledge:

• Rentaba cannot guarantee how shared data affects credit reports/scores.
  
• You are solely liable for inaccurate information reported.
  
• Tenant screening requires written consent from applicants/tenants.
  
• Rent decisions are your responsibility; Rentaba provides no recommendations.
  

4. Content Rights

‍4.1 User Content:

• You retain ownership but grant Rentaba a global, royalty-free license to use, modify, and display content to operate the Services.
  

4.2 Rentaba Content:

• All Platform software, design, and non-user-generated content are Rentaba’s intellectual property.
  

4.3 Prohibited Content:

• No unlawful, abusive, discriminatory, or infringing material.
  
• No spam, viruses, or impersonation.
  
• Rentaba may remove violating content without liability.
  

5. Termination

• User-Initiated: Cancellation deletes all User Content without recovery options. No refunds for partial periods.
  
• Rentaba-Initiated: Unpaid accounts may be deactivated without notice.
  

6. Conduct & ComplianceYou agree not to:

• Violate laws or third-party terms integrated with Services.
  
• Reverse-engineer, hack, or overload the Platform.
  
• Resell, copy, or compete with Rentaba for 1 year post-use.
  

7. Disclaimers & Limitations

‍7.1 No Warranties:

• Services are provided "AS IS." Rentaba disclaims all implied warranties (merchantability, fitness for purpose, etc.).
  

7.2 Liability Cap:

• Rentaba’s total liability is capped at $10,000 USD or fees paid in the last 12 months (whichever is lower).
  
• No liability for indirect, incidental, or consequential damages.
  

8. IndemnificationYou agree to defend and indemnify Rentaba against claims arising from:

• Your misuse of Services;
  
• Violations of these Terms;
  
• Infringement of third-party rights.
  

9. Dispute Resolution

‍9.1 Governing Law:

• Disputes are governed by Pennsylvania law (U.S.), excluding conflict-of-law principles.
  

9.2 Arbitration:

• Mandatory individual arbitration (no class actions or jury trials).
  
• Claims must be filed within 1 year of the incident.
  
• Process:a) Notify Rentaba at support@rentaba.co;b) 30-day negotiation period;c) Arbitration via a single arbitrator in Philadelphia, PA.
  

10. General Provisions

• Severability: Invalid clauses do not void remaining Terms.
  
• Assignment: Rentaba may transfer this Agreement; you may not.
  
• Survival: Sections on liability, indemnity, and arbitration persist post-termination.
